Welcome to Fitley. By using our app, you agree to these Terms of Service.
Acceptance of Terms
By downloading, accessing, or using Fitley ("the App"), you agree to be bound by these Terms. If you do not agree, do not use the App.
Description of Service
Fitley provides:
Face analysis and personalized recommendations
Calorie and nutrition tracking
Habit and routine tracking
Calendar and scheduling features
Leaderboard and community features
Eligibility
You must be at least 13 years old to use Fitley. By using the App, you represent that you meet this requirement.
Account Registration
You may create an account using Apple Sign-In, Google Sign-In, or continue as a guest. You are responsible for maintaining the security of your account and all activities under it.
Subscriptions and Payments
5.1 Fitley offers premium subscriptions:
Weekly: $3.99 per week
Yearly: $29.99 per year (includes 3-day free trial)
5.2 Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
5.3 Payment is charged to your Apple ID account upon confirmation of purchase.
5.4 You can manage or cancel subscriptions in your device Settings → Apple ID → Subscriptions.
5.5 Refunds are handled by Apple according to their refund policies.
User Content
6.1 You retain ownership of photos and content you upload.
6.2 By uploading content to the leaderboard, you grant Fitley a license to display it within the App.
6.3 You agree not to upload content that is:
Illegal or promotes illegal activity
Offensive, hateful, or harassing
Sexually explicit or inappropriate
Infringing on others' rights
6.4 We reserve the right to remove content that violates these terms.
Leaderboard and Community
7.1 Leaderboard submissions are visible to other users.
7.2 You agree to treat other users with respect.
7.3 We may remove users who violate community standards.
Prohibited Conduct
You agree not to:
Use the App for unlawful purposes
Harass or harm other users
Attempt to hack or disrupt the App
Create fake accounts or impersonate others
Scrape or collect user data
Reverse engineer the App
Intellectual Property
The App, its design, features, and content are owned by Fitley and protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the App without permission.
Disclaimers
10.1 The App is provided "as is" without warranties of any kind.
10.2 Face analysis results are for informational and entertainment purposes only. They are not medical advice.
10.3 Nutrition tracking is for personal reference. Consult a healthcare professional for dietary advice.
10.4 We do not guarantee specific results from using the App.
Limitation of Liability
To the maximum extent permitted by law, Fitley shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
Indemnification
You agree to indemnify and hold harmless Fitley from any claims arising from your use of the App or violation of these Terms.
Account Deletion
You may delete your account at any time in Settings → Delete Account. This permanently removes your data from our servers.
Termination
We reserve the right to suspend or terminate your account for violation of these Terms.
Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of Michigan, United States.
